Full Sweepstakes Rules and Regulations
Please read these Sweepstakes rules (“Sweepstakes Rules”) in their entirety before entering the Sweepstakes. Do not enter the Sweepstakes unless you agree to these Sweepstakes Rules. Participation in the Sweepstakes constitutes unconditional agreement and acceptance of these Sweepstakes Rules which are final on all matters relating to the Sweepstakes. By entering this Sweepstakes you agree to be bound by the decisions of Sweepstakes judges which are final and binding in all respects.
1. SWEEPSTAKES PERIOD: The Sweepstakes runs from Sunday, September 1, 2013 at 12:00:01 a.m. (ET) to Tuesday, October 1, 2013 at 11:59:59 p.m. (ET). (the “Sweepstakes Period”).
2. ELIGIBILITY: This Sweepstakes is open to legal residents of Canada, excluding the Province of Quebec, who have reached the age of majority in their province or territory of residence on or before the start of the Sweepstakes Period. Employees of Herbal One (the “Sponsor”), its franchisees, nvision solutions, and those with whom they are domiciled, their affiliates, agents, advertising or promotional agencies or the independent Sweepstakes organization are not eligible.
3. HOW TO ENTER: NO PURCHASE NECESSARY. To be eligible, entrants must have “Liked” the Herbal One Facebook Page and entered the sweepstakes by completing the Entry Page on the Herbal One Facebook Page.
4. Guaranteed PRIZE: One prize will be awarded. The sweepstakes winner may choose either a $400 travel voucher redeemable at Great Wolf Lodge in Niagara Falls or a package of Herbal One products and services worth $400 (msrp). The odds of being selected will depend on the total number of eligible entries received. The Prize must be accepted as awarded. The Sponsor reserves the right to substitute the Prize in whole or in part in the event that all of any component of the Guaranteed Prize is unavailable. Any taxes and other incidental charges on the Guaranteed Prize are the sole responsibility of the winner.
5. CONSENT TO MARKET TO ENTRANTS: By entering this Sweepstakes, each entrant permits the Sponsor, its agents, promotional agencies, representatives and Sweepstakes judges to collect the information submitted with the entry and to use it to administer the Sweepstakes. You also permit the Sponsor and its franchisees to use this information to promote to you products and services that may be of interest to you, unless prohibited by law. The Sponsor and its franchisees may communicate with you through various channels, including email, using the contact information you have provided. 6. DRAW: A random selection to select one potential winner will be made in Vaughan, Ontario at 2:00 pm ET on Monday, October 7, 2013 from all eligible entries received by the end of the Sweepstakes Period.
Guaranteed Prize: Before being declared a winner, the selected entrant (eligible according to the official rules) will be contacted by email, and must correctly answer a mathematical skill-testing question to be posed by telephone or via email at a mutually convenient time and date. If the selected entrant incorrectly answers the skill-testing question, or cannot be contacted within 7 days of being selected, his or her entry will be disqualified and another will be randomly selected until the Guaranteed Prize has been awarded. The winner will be notified by the Sponsor to make arrangements for the awarding of the Guaranteed Prize. The winner will be required to sign a standard Declaration of Compliance, Liability Release form and Publicity Release consenting to the use of his/her name, city or province and/or photograph, without further compensation, in any publicity carried out by the Sponsor, its franchisees and/or its advertising and promotional agencies relative to this Sweepstakes. The decisions of the Sweepstakes organizers are final and binding.
7. ADDITIONAL TERMS: All entries become the property of the Sponsor who assumes no responsibility for illegible, lost, late, delayed, deleted or misdirected email, voice messages, or any computer
errors or malfunctions. The Sponsor, its franchisees, nvision solutions, and those with whom they are domiciled, their affiliates, agents, advertising or promotional agencies or the independent Sweepstakes organization, does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or illegible data or transmissions, omission, interruption, deletion, effect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void.
8. If for any reason, in the opinion of the Sponsor, in its/their sole discretion, the Sweepstakes is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the Sweepstakes is corrupted or adversely affected, including but not limited to, by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes, the Sponsor reserves its/their right, without need of individual notice, to cancel, terminate, modify, amend, extend or suspend the Sweepstakes in whole or in part, including, without limitation, canceling any method of entry, and/or selecting a winner from previously received eligible entries. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Sweepstakes Rules or otherwise in a disruptive manner. Any attempts to deliberately damage any website or to undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such attempt be made the Sponsor reserves its right to seek remedies and damages to the fullest extent of the law. Sweepstakes sponsors its franchisees, nvision solutions, and those with whom they are domiciled, their affiliates, agents, advertising or promotional agencies or the independent Sweepstakes organization shall not be held responsible for any errors or negligence that may arise or occur in connection with the Sweepstakes including any damage to an entrant’s computer equipment, system software or any combination thereof, as a result of their participation in this Sweepstakes or from downloading any material from the Sweepstakes website, where applicable.
9. Sweepstakes sponsors its franchisees, nvision solutions, and those with whom they are domiciled, their affiliates, agents, advertising or promotional agencies or the independent Sweepstakes organization shall not be held responsible for any personal or property loss, injury or damage due to redemption and use of the any Grand Prize.
10. Any litigation in regards to the conduct or organization of this publicity Sweepstakes must be initiated in the City of Vaughan, in Ontario, Canada.
11. To receive the name of the Sweepstakes winner, please send a self-addressed and stamped envelope to “Herbal One “Fall 2013” Sweepstakes – 2-1000 Creditstone Road, Vaughan, ON, L4K 4P8.”
12. This Sweepstakes is subject to all Federal, Provincial and Municipal laws and regulations applicable in Canada. This Sweepstakes is void where prohibited or otherwise restricted by law.
